Bandung, BEREDUKASI.Com — BERDASARKAN pasal 31 ayat 1 Undang-Undang Dasar 1945 yang berbunyi “Setiap warga negara berhak mendapat pendidikan”. Dengan adanya pasal tersebut membuat Kemenristekdikti melakukan terobosan dalam kegiatan belajar mengajar, salasatunya dengan memberlakukannya Pembelajaran Jarak Jauh atau yang lebih sering disapa PJJ.
PJJ adalah proses belajar mengajar yang dilakukan secara jarak jauh melalui penggunaan berbagai media komunikasi. Ternyata PJJ ini memiliki Dasar Hukum yang tertuang dalam Peraturan Mentri Pendidikan dan Kebudayaan nomor 7 tahun 2020 tentang Pendirian, Perubahan, Pembubaran Perguruan Tinggi Negeri dan Pendirian, Perubahan, Pembubaran Perguruan Tinggi Swasta.
Menurut pasal 57 ayat 1 huruf b pada Peraturan Mentri tersebut dijelaskan bahwa setiap perguruan tinggi yang menyelenggarakan PJJ harus berakreditasi A atau Unggul, Dalam kondisi pandemi Covid-19, hampir seluruh kampus di Indonesia melakukan PJJ melalui berbagai platform dalam jaringan tanpa terkecuali.
Apabila perguruan tinggi mengabaikan syarat pembukaan PJJ maka kementrian dapat memberikan sanksi berupa penutupan kampus berdasarkan pasal 66 ayat 1 huruf a yang berbunyi “Pencabutan izin perguruan tinggi penyelenggara PJJ dilakukan dengan alasan perguruan tinggi penyelenggara PJJ dinyatakan tidak terakreditasi oleh Badan Akreditasi Nasional Perguruan Tinggi”.
Apabila menilik peraturan hukum di masa pandemi Covid-19, terdapat suatu peraturan hukum yang mengatur mengenai Penyelenggaraan Program Satuan Pendidikan Aman Bencana yang tertuang dalam Peraturan Mentri Pendidikan dan Kebudayaan nomor 33 tahun 2019. Namun dalam peraturan tersebut penulis tidak menemukan penjelasan secara eksplisit mengenai pelaksanaan PJJ dimasa pandemi Covid-19. Berdasarkan pasal 2 huruf e pada peraturan tersebut
“Penyelenggaraan Program Satuan Pendidikan Aman Bencana bertujuan untuk memberikan layanan pendidikan yang sesuai dengan karakteristik Risiko Bencana dan kebutuhan Satuan Pendidikan”.
Menurut asumsi penulis terdapat suatu kesenjangan antara das sein dan das sollen karena disatu sisi hampir seluruh perguruan tinggi di Indonesia menerapkan PJJ untuk kelangsungan kegiatan belajar mengajar dimasa pandemi Covid-19, Namun disatu sisi terdapat Peraturan Mentri Pendidikan dan Kebudayaan tentang tata cara melakukan PJJ yang notabene tidak semua perguruan tinggi di Indonesia telah memenuhi syarat pemberlakuan PJJ yang sesuai dengan Peraturan Mentri Pendidikan dan Kebudayaan nomor 7 tahun 2020 Maka penulis mendukung dan mengharapkan adanya revisi atas Permendikbud nomor 7 tahun 2020 tentang Pendirian, Perubahan, Pembubaran Perguruan Tinggi Negeri dan Pendirian, Perubahan, Pembubaran Perguruan Tinggi Swasta, fokus utama dalam revisinya adalah syarat-syarat penerapan PJJ dimasa pandemi dan sanksi yang diberikan kementrian kepada perguruan tinggi yang belum memenuhi syarat pemberlakukan PJJ namun telah melakukan PJJ dimasa pandemi.
