Jakarta, BEREDUKASI.Com — Nigiyati Tan, korban hutang piutang, masih harus bersabar menanti kejelasan terkait kasus uang yang dipinjamkan kepada rekannya, Erna Suparto, sejumlah 1 milyar rupiah.
Setelah gugatan Perdata dari (Terdakwa) Erna Suparto ditolak Majelis Hakim Pengadilan Negeri Jakarta Selatan, kini kasus tersebut. Kembali disidangkan secara Pidana di Pengadilan Negeri, Jakarta Utara, Selasa (2/2/2021).
Sayangnya sidang yang beragendakan tuntutan seraya mendengarkan keterangan Saksi Ahli dari pihak Terdakwa terpaksa ditunda sepekan ke depan, Selasa (9/2/2021), lantaran Saksi Ahli berhalangan untuk hadir.
Menurut Jaksa Fungsional, Lina Hendraswari, SH, pihak terdakwa tidak dapat memberi Bukti Slip Transferan pembayaran hutang yang asli, kecuali hanya lampirannya saja.
“Makanya saya mau masukkan dalam tuntutan. Mereka muter-muter ngomongnya. Jadi patut diduga telah melakukan penggelapan dan penipuan. Ancaman pidananya bisa Empat Tahun karena kena pasal 372 dan 378,” ujar Lina Hendraswari, yang menangani kasus ini.
Ditempat yang sama Nigiyati Tan, selaku korban mengaku sudah merasa lelah mengikuti persidangan yang telah berjalan selama satu tahun belakangan ini.
“Urusan begini capek hati capek fisik. Lelah mengikuti persidangan selama setahun ini sejak 2019. Tapi demi mendapatkan keadilan ya, mau bagaimana lagi harus dijalani,” kata Nigiyati Tan.
Menurut Nigiyati , sejak awal Erna memang sudah tidak memiliki iktikad baik untuk membayar hutang.
“Jika dia (Erna Suparto) punya uang lebih senang gunakan uangnya untuk menuntut balik secara perdata. Beruntung gugatan Erna secara Perdata ditolak,” ujar Nigiyati.
Sidang saat ini, kata Nigiyati, merupakan Sidang Kasus Pidana. Unsurnya Penipuan dan Penggelapan.
“Erna sudah ditahan karena gugatan perdatanya ditolak di PN Jakarta Selatan,” ujar Nigiyati.
Nigiyati Tan berharap kasusnya segera selesai dan mendapat keadilan berdasarkan bukti-bukti yang lengkap.
“Bukti Transferan Giktif. Rekaman suara melallui WA dan bukti lainnya, saya semua punya lengkap. Saya hanya berharap Keadilan. Adil di Mata Hukum dan di Mata Tuhan. Kalau berharap uang saya kembali rasanya itu enggak mungkin,” ujarnya. (Eddie Karsito).
